Virginia Seeks Peace, Radicals Seek War

No initiatives for peaceful compromise, nor peaceful and practical solution to African slavery were forthcoming from either Abraham Lincoln or the Republican party. Their policy since Lincoln’s election was steadfast resistance to any measures that would resolve the sectional differences. Congress was by February 1861 dominated by Northern politicians after the departure of several Southern States and had free reign over legislation which would have averted war between Americans.

Virginia Seeks Peace, Radicals Seek War

“[T]he Old Dominion, true to her traditional policy of taking the initiative in times of crisis, assumed the role of peacemaker. The legislature passed joint resolutions on January 19 calling for a peace convention to be held in Washington. An invitation was extended to the other States to appoint commissioners to meet in Washington on February 4 “to consider and, if practical, agree upon some suitable adjustment.” The opinion was expressed that the Crittenden Compromise, then pending in the Senate, would with some modification serve as a basis for adjustment.

These resolutions provided for the appointment of [former President] John Tyler as commissioner to the President of the United States and Judge John Robertson commissioner to the seceded States. They were instructed respectively to request the President . . . and the authorities of the seceded States to abstain, pending the action of the proposed peace convention, from “all acts calculated to produce a collision of arms between the States and the Government of the United States.”

Congress, however, paid no attention to the Virginia resolutions. In neither House were they printed or referred to a committee. They were soon allowed to lie on a table unnoticed.

Tyler left Washington on January 29 with the expectation of returning for the Peace Convention . . . On the day before leaving, he sent another letter to President Buchanan [which] expressed appreciation for the courtesies that had been shown him and pleasure of hearing the President’s message read in the Senate. He spoke of a rumor to the effect that at Fortress Monroe the cannon had been put on the land side and pointed inland.

His comment on this report was “that when Virginia is making every possible effort to redeem and save the Union, it is seemingly ungenerous to have cannon leveled at her bosom.” To this letter Buchanan sent a very courteous reply, stating that he would inquire into the rumors with reference to Fortress Monroe.”

Lee’s Loyalty and Interest

The New England philosopher Josiah Royce wrote in his “Philosophy of Loyalty” that it “seems clear that the correctness of one’s judgment is not the test of loyalty,” and that “one who makes a decision, after due care and investigation, and remains steadfast, therefore constitutes loyalty. Thus did he select Robert E. “Lee as an example of the loyal man.”

Lee’s Loyalty and Interest

“[Royce] maintains that Lee fairly considered and honestly decided the question at issue between Virginia and the United States and was steadfast therein. Charles Francis Adams came to the same conclusion. “As to Robert E. Lee individually,” says Adams, “I can only repeat . . . [that] I hope I should have been filial and unselfish enough to have done as Lee did.”

Now it must be conceded that every man in the seceding States, whether he would or no, had to decide whether he would adhere to his State or to the Nation, and if he decided honestly and put self-interest behind him, he decided right.

With Lee it was not a question of the constitutional right of Virginia to withdraw from the Union; a more trying ordeal confronted him: What should be his action after Virginia actually withdrew? In this situation Lee had no misgivings; his allegiance was to Virginia.

But, in arriving at this decision, he was not dogmatic, for he realized that there might be two sides to the question. In a letter of April 20 to his cousin, Roger Jones, of the United States Army, he stated that he entirely agreed with him in his notions of allegiance, but he could not advise him. “I merely tell you what I have done that you may do better.”

This sentence has been subjected to criticism, yet it is characteristic of the style of Lee and of Southern conservatives generally. Though it is not self-deprecating it is not an admission of error. It does not affirm that there is something better, but that if there is the young man should do it. The sentence is susceptible of another construction: Lee was quietly boasting and implied that there was nothing better! But the context leads to the opposite conclusion. Such under-statements mark the cultured Southerner of the period.

Lee did not complain of Southern officers who felt it their duty to remain in the Union – other might choose this course but he could not. No more could have laid violent hands on Virginia than on his own father. If to fight against the Union caused him to shed tears of blood, to have fought against Virginia would have caused him to lose self-respect.

[George H.] Thomas, a Virginian, remained true to the Union; so did [Montgomery] Meigs of Georgia, and [Winfield Scott . . . That these men were loyal Lee did not doubt. When Thomas was asked how he could fight against Virginia, he replied, “I have educated myself not to feel.”

As to Scott, he was an old man and had no local ties; he was as much at home in London as in Richmond. [Lee’s cousin] Admiral Samuel P.] Lee was once asked the question propounded to Thomas and answered, “When I find the word Virginia in my commission I will join the Confederacy.” This reply seems technical.

If Washington had so concluded, when he read the King’s Commission, he would not have led the Continentals against the Crown. And what Washington did, Lee did. “For,” as Lee declared, “Washington found no inconsistency in fighting, at one time, with the English against the French and, at another, with the French against the English.”

Lee, indeed, saw an analogy between the Revolution of 1776 and the Revolution of 1861. Colonists threw off the yoke of Great Britain, in ’61 eleven Southern States threw off the yoke of the North. In each the act was one of revolution. Lee maintained that a government held together by coercion – such as Lincoln’s call for troops would create – was but the semblance of a government. He remembered that Washington himself had declared, “There is nothing that binds one country or one State to another but interest.”

The South was the Conservative Party

To many the abolition crusade recalls brave Northerners standing tall for the liberty of African slaves and the Rights of Man. Upon closer inspection the North was a region unfriendly to both the black man and abolitionists – the latter evident with the mob-murder of Elijah Lovejoy in antebellum Illinois. Daniel Webster saw these sectionalists for what they were, and what evil they might accomplish.

The South Was the Conservative Party

“The story of Daniel Webster and his great speech in 1850 has been told at some length because it is instructive. The historians who have set themselves to the task of upholding the idea that it was the aggressiveness of the South, during the controversy over slavery, and not that of the North, that brought on secession and war, could not make good their contention while Daniel Webster and his speech for “the Constitution and Union” stood in their way. They, therefore, wrote the great statesman “down and out” as they conceived.

But Webster and that speech still stand as beacon lights in the history of that crusade. The attack came from the North. The South, standing for its constitutional rights in the Union, was the conservative party. Southern leaders, it is true, were, during the controversy over slavery, often aggressive, but they were on the defensive—aggressive, just as Lee was when he made his campaign into Pennsylvania for the purpose of stopping the invasion of his own land.

Mr. Webster in his great speech for “the Constitution and the Union,” as became a great statesman, pleading for conciliation, measured the terms in which he condemned “personal liberty” laws and Abolitionism. But afterward, irritated by the attacks made upon him, he naturally spoke out more emphatically.

McMaster quotes several expressions from his speeches and letters replying to these assaults, and says: “His hatred of Abolitionists and Free-Soilers grew stronger and stronger. To him these men were a “band of sectionalists, narrow of mind, wanting in patriotism, without a spark of national feeling, and quite ready to see the Union go to pieces if heir own selfish ends were gained.” Such, if this was a fair summing up of his views, was Webster’s final opinion of those who were carrying on the great anti-slavery crusade.”

The Imprint of the War Between the States

The American South fought for its rightful place on these shores and when denied parity in the Union of the Founders’, it would have it in its own American nation and as envisaged in Jefferson’s Declaration of Independence. The energetic resort to arms by Southerners was the response of a free people defending their ancient political rights as Englishmen.

The Imprint of the War Between the States

“The people of the South,” wrote George Fort Milton, of Tennessee, historian of the Confederate War and its aftermath, “probably have the closest contact with the true fundamentals of democracy of any portion of our national citizenship. We have had fewer lush days to lead us into forgetfulness of the early faiths.”

Senator Burnet R. Murbank, of South Carolina, agreed. “An instinctive patriotism,” he called it, “an immutable determination vigorously to defend the security of their country and their sovereign rights against unjust and unwanted inroads from any quarter . . . These characteristics are not engendered by any adverse material or educational conditions.”

Senator Lister Hill, of Alabama, made a similar point after mentioning the English stock and tradition and the “imprint of the War Between the States.” He thought “Southerners are more belligerent not just about this war [against Germany] but about everything that pertains to their rights and their country . . . not merely because they are a people quick to action once their emotions are aroused but because they are willing to make a great sacrifice in this struggle for democracy just as their forebears risked their lives.”

Chancellor Oliver Cromwell Carmichael, of Vanderbilt University, believed that “the great belligerence of the South towards this war is due to its greater abhorrence of dictatorship and greater love of liberty and freedom. The spirit of . . . Robert E. Lee is still reflected in the background and thinking of the mass of Southern peoples and expresses itself in the vitality of its opposition to tyrannical systems.”

There is the remembrance that in the war the ruling class in England sided with the Southern cause . . . [and So Red the Rose author Stark] Young [mentions] a theory that modern German methods of invasion and destruction [are] derived from ones used against the South in the Confederate War. “Many a Southerner, reading news of the German war over England, has by inheritance a certain added perception of its impact.” He quoted James Truslow Adams’ “America’s Tragedy”:

“In 1870, when Germany was fighting France, [Union army General] Sheridan had gone over as a private observer but was received by Bismarck and other high officials, both civil and military. Dr. Busch, the biographer of Bismarck, notes that at a dinner given by the Chancellor the discussion turned to the recent conduct of some of the German forces, and Councillor Abeken thought that war should be conducted in a more humane fashion.

Sheridan denied this, says Busch, and expressed himself roughly as follows:

“The proper strategy consists in the first place in inflicting as telling blows as possible upon the enemy’s army, and then in causing the inhabitants so much suffering that they must long for peace, and force their government to demand it. The people must be left with nothing but their eyes to weep with over the war.”

The German noted in his journal: “Somewhat heartless it seems to me, but perhaps worthy of consideration.” During the [First] World War the Bishop of London, in an address quoted the words of the American general but attributed them to the Kaiser.”

Major Anderson’s Reluctance at Fort Sumter

In his “Rise and Fall”, Jefferson Davis wrote that it is “undeniably that the ground on which Fort Sumter was built was ceded by South Carolina to the United State IN TRUST for the defense of her own soil and her own chief harbor. No other State or combination of States could have any distinct interest or concern in the maintenance of a fortress at that point, unless as a means of aggression against South Carolina herself.” He added that the North’s claim that it was public property was untenable unless stated from an imperial view of total control over the people of that State.

Major Anderson’s Reluctance at Fort Sumter

“The course pursued by the government of the United States with regard to the forts had not passed without earnest remonstrance from the most intelligent and patriotic of its own friends . . . [Senator Stephen] Douglas of Illinois – who was certainly not suspected of sympathy with secession, or lack of devotion to the Union – on March 15th offered a resolution recommending the withdrawal of the garrisons from all forts within the limits of the States that had seceded, except those at Key West and the Dry Tortugas. In support of the resolution he said:

“We certainly cannot justify the holding of forts there, much less the recapturing of those which have been taken, unless we intend to reduce those States themselves into subjection. I take it for granted, no man may deny the proposition, that whoever permanently holds Charleston and South Carolina is entitled to possession of Fort Sumter.

Whoever permanently holds Pensacola and Florida is entitled to the possession of Fort Pickens. Whoever holds the States in whose limits those forts are placed is entitled to the forts themselves. Unless there is something peculiar in the location of some particular fort that makes it important for us to hold it for the general defense of the whole country, its commerce and interests, instead of being useful only for the defense of a particular city or locality.

It is true that Forts Taylor and Jefferson, at Key West and Tortugas, are so situated as to be essentially national, and therefore important to us without reference to the seceded States. Not so with Moultrie, Johnson, Castle Pinckney, and Sumter, in Charleston Harbor; not so with Pulaski, on the Savannah River . . .

We cannot deny that there is a Southern Confederacy, de facto, in existence, with its capital in Montgomery. We may regret it. I regret it most profoundly; but I cannot deny the truth of the fact, painful and mortifying as it is . . . I proclaim boldly the policy of those of with whom I act. We are for peace.”

Mr. Douglas, in urging the maintenance of peace as a motive for the evacuation of the forts, was no doubt aware of the full force of his words. He knew that their continued occupation [by Lincoln] was virtually a declaration of war [on the South].

The general-in-chief of the United States Army, also, it is well-known, urgently advised the evacuation of the forts. But the most striking protest against the coercive measure finally adopted was that of [Fort Sumter commander] Major Anderson himself. The letter in which his views were expressed has been carefully suppressed in the partisan narratives of that period and well-nigh lost sight of, although it does the highest honor to his patriotism and integrity.

It was written on the same day on which the announcement was made to Governor Pickens of the purpose of the United States government to send supplies to the fort, and it is worthy of reproduction here:

“Letter of Major Anderson . . . Protesting Against [Secretary of War] Fox’s Plan for Relieving Fort Sumter.

Fort Sumter, April 8, 1861

To Colonel L. Thomas, Adjutant-General, United States Army.

Colonel: . . . I had the honor to receive, by yesterday’s mail, the letter of the Honorable Secretary of War, dated April 4th, and confess that what he states surprises me very greatly – following, as it does, and contradicting so positively, the assurance Mr. Crawford telegraphed he was “authorized” to make.

I trust that this matter will be at once put in a correct light, as a movement made now, when the South has been erroneously informed that none such would be attempted, would produce most disastrous results throughout our country. It is, of course, now too late for me to give any advice in reference to the proposed scheme of Captain Fox.

We shall strive to do our duty, though I frankly say that my heart is not in this war, which I see is about to be thus commenced. That God will still avert it, and cause us to revert to pacific means to maintain our rights, is my ardent prayer.

Your obedient servant, Robert Anderson, Major, 1st Artillery, commanding.”

This frank and manly letter . . . fully vindicates Major Anderson from all suspicion of complicity or sympathy with the bad faith of the government he was serving. The “relief squadron,” as with unconscious irony it was termed, was already underway for Charleston, consisting, according to their own statement, of eight vessels, carrying twenty-six guns and about fourteen hundred men, including the troops sent for reinforcement of the garrison.

These facts became known to the Confederate government, and it was obvious that no time was to be lost in preparing for, and if possible anticipating the impending assault.”

Lincoln’s Deception Leads to War

After President James Buchanan’s failed Star of the West mission to resupply Fort Sumter in early January, 1861, Lincoln attempted the same in early April while promising to maintain the peaceful status quo. Judge John A. Campbell was a respected Supreme Court Justice who tried honestly to facilitate a peaceful settlement between North and South, but was deceived by those leading the war party of the North. Unionists North and South advised Lincoln to abandon Sumter to avoid a conflict between Americans.

Lincoln’s Deception Leads to War

Judge Campbell to the President of the Confederate States.

Montgomery, Alabama, May 7, 1861

“Sir:  I submit to you two letters that were addressed by me to the Hon. W. H. Seward, Secretary of State of the United States, that contain an explanation of the nature and result of an intervention by me in the intercourse of the commissioners of the Confederate States with that officer.

I considered that I could perform no duty in which the entire American people, whether of the Federal Union or of the Confederate States, were more interested than that of promoting the counsels and the policy that had for their object the preservation of peace. This motive dictated my intervention.

Besides the interview referred to in these letters, I informed the Assistant Secretary of State of the United States (not being able to see the Secretary) on the 11th April, ultimo, of the existence of a telegram of that date, from General Beauregard to the commissioners, in which he informed the commissioners that he had demanded the evacuation of Sumter, and if refused he would proceed to reduce it.

On the same day, I had been told that President Lincoln had said that none of the vessels sent to Charleston were war vessels, and that force was not to be used in the attempt to resupply the Fort. I had no means of testing the accuracy of this information; but offered that if the information was accurate, I would send a telegram to the authorities at Charleston, and it might prevent the disastrous consequences of a collision at that fort between the opposing forces. It was the last effort that I would make to avert the calamities of war.

The Assistant Secretary promised to give the matter attention, but I had no other intercourse with him or any other person on the subject, nor have I had any reply to the letters submitted to you.

Lincoln’s Duplicity at Fort Sumter

The land ceded to the federal agent at Washington for forts, arsenals and yards by individual States were intended for the protection, not destruction, of the States they were located in. If a fort was to be used by that agent for a warlike purpose against a State, it is obvious that State would immediately eject the federal employees. Lincoln in early 1861 sent spies to Charleston to gather intelligence before he commenced war.

Lincoln’s Duplicity at Fort Sumter

“There are many matters of interest and importance connected with the firing upon Fort Sumter which are not generally mentioned in our American histories. These are given in some detail in Dr. H.A. White’s “Life of Robert E. Lee.” Such information is essential to an understanding of the whole subject of the beginnings of the sectional conflict.

“. . . It will be an advantage for the South to go off,” said H.W. Beecher. After the inauguration of Mr. Lincoln there was a strong current opinion in the North that the Federal troops should be withdrawn from the Southern forts. President Lincoln’s “organ,” the National Republican, announced that the Cabinet meeting of March 9 had determined to surrender both Sumter and Pickens.

That [Major Robert] Anderson would be withdrawn from Sumter “was the universal opinion in Washington (Rhodes, U.S., vol. iii, p. 332). Welling, of the National Intelligencer, was requested by [William] Seward to communicate the Cabinet’s purpose to George W. Summers, member of the Virginia Convention (The Nation, Dec. 4, 1879). March 15 Secretary Seward unofficially notified the Confederate Commissioners, through Justice Campbell of the Supreme Court, that Sumter would be yielded at once to the Southern Confederacy.”

“. . . March 24 brought Colonel Ward H. Lamon of Washington to Fort Sumter. He obtained permission from Governor Pickens to visit Major Anderson upon the representation that he had come as “confidential agent of the President,” to make arrangements for the removal of the garrison. The impression produced upon Major Anderson by Lamon, as well as upon the officers and men of the garrison, was that the command was to be withdrawn.” Lamon informed Governor Pickens “that the President professed a desire to evacuate the work.” After Lamon’s return to Washington he sent a written message to Pickens, that he “hoped to return in a very few days to withdraw the command.”

Taxes Only for Public Objects and Ends

In May of 1882 Delaware’s Senator Bayard recalled the meaning of the Mecklenburg Resolves and warned against the continuing expenditure of public tax dollars on projects unrelated to a strictly “public objects and ends.” Americans then were witnessing a federal government, unrestrained since 1861, complicit in subsidies to private businesses and pursuing vast imperial ambitions.

“The commemorative celebration of the Mecklenburg Declaration of Independence took place at Charlotte on May 20th [1882]. The streets were fairly decked with flags and banners, filled with citizen soldiers in bright uniforms, and at least 20,000 people from the surrounding country.

Governor [Thomas] Jarvis and his staff, Senators Vance, [Matt] Ransom, Wade Hampton and [Thomas] Bayard were present. The Mecklenburg Declaration was read by Senator Ransom, and Senator Vance introduced the orator of the occasion, Thomas F. Bayard of Delaware. The address was enthusiastically received, especially the sentiments contained in the following extract:

“I wish I could impress upon you gentlemen, and not upon you only but upon our fellow-countrymen everywhere, the fatal fallacy and mischief that underlies and inheres to every proposition to use the money of the people — drawn from them by taxation, the powers of the government, the force of their government, under any name or pretext — for any other than really public objects and ends.

I include the maintenance of the public honor, dignity, and credit, the protection of American citizenship everywhere, among the just objects for the exercise of governmental powers; but I wish to deny . . . the rightfulness of involving the welfare and happiness of the 50,000,000 men, women, and children of the country, whether by laying taxes upon them which are not needed for the support of their government, or paying bounties and subsidies to maintain lines of private business which are too unskillfully or unprofitably conducted otherwise to sustain themselves, or promising the presence of our fleets or armies, or risking the issue of peace or war, or shedding the blood of our soldiers and sailors in aid of schemes of private greed or personal ambition under the guise of claims foreign or domestic.”

New England Rebels and Tyrants

Admiral Raphael Semmes wrote in the immediate postwar that “Constitutions are made for the protection of minorities,” that “they naturally cling to the guarantees and defences provided for them in the fundamental law; it is only when they become strong” and become majorities “that their principles and their virtues are really tested.” He was referring to New England which when in the minority was firmly for States’ rights, but in 1860 when it became the majority, became strongly nationalist and embarked on a path to subjugate the South.

New England Rebels and Tyrants

“The American Constitution died of a disease that was inherent in it. It was framed on false principles inasmuch as the attempt was made, through its means of binding together, in a republican form of government, two dissimilar peoples, with widely dissimilar interests.

Monarchical governments may accomplish this since they are founded by force, but republican governments never. The secession of the Southern States was a mere corollary of the American proposition of government; and the Northern States stultified themselves, the moment they started to resist it. The consent of the Southern States being wanted, there should have been an end of the question.

If the Northern States were not satisfied to let them go, but entertained, on the contrary, a desire to restrain them by force, this was a proof that those States had become tired of the republican form and desired to change it.

So loth was the South to abandon the Union that she made strenuous efforts to remain in it, even after Mr. Lincoln had been made president in 1860. In this election that dreaded sectional line against which President Washington had warned his countrymen in his Farewell Address, had at last been drawn . . . There had at last arisen a united North, against a untied South.

[Lincoln’s election] was purely geographical; it was tantamount to a denial of the co-equality of the Southern States with the Northern States, since it drove the former out of the common Territories. In both houses of Congress the Northern faction which had so recently triumphed in the election of their president, was arrayed in hostility to the South, and could not be moved [to compromise] an inch. Rebels, when in a minority, [New Englanders] had become tyrants now that they were in a majority.

Nothing remained to the South, but to raise the gauntlet which had been thrown at her feet. The federal government which had been established by our ancestors had failed of its object. Instead of binding the States together, in peace, and amity, it had, in the hands of one portion of the States, become an engine of oppression of the other portion. It so happened, that the slavery question was the issue which finally tore them asunder, but . . . this question was a mere means, to an end.

[That] end was empire . . . in this hemisphere, the drama which had so often been enacted in the other, of the more powerful nation crushing out the weaker.

The war between the American sections was but the prototype of many other wars, which have occurred among the human race. It had its origin in the unregenerated nature of man, who is only an intellectual wild beast, whose rapacity has never yet been restrained, by a sense of justice. The American people thought, when they framed the Constitution that they were to be an exception to mankind, in general.

History had instructed them that all other peoples, who had gone before them had torn up paper governments, when the paper was the only bulwark that protected such governments, but then they were the American people, and no such fate could await them.”

Generations Living Off Future Generations

Jefferson wrote in 1792: “As the doctrine is that a public debt is a public blessing, so they think a perpetual one is a perpetual blessing, and therefore wish to make it so large that we can never pay it off.” Prior to 1861 it as common for American presidents to view that indebting future administrations was both immoral and unconscionable.

Generations Living Off Future Generations

“On September 6, 1789, Jefferson admonished James Madison from Paris that the country should get straight, “at the threshold of our new government,” how we are to keep the debt from destroying the democracy. Jefferson’s premise, which he believed to be “self-evident,” is that one generation cannot – either morally or in fact – bind another.

It follows that “No generation can contract debts greater than may be paid during the course of its own existence.” The “earth belongs in usufruct [trust] to the living . . . [T]he dead have neither powers nor rights over it.” If one generation can charge another for its debts, “then the earth would belong to the dead and not to the living generation.”

Jefferson continued: “The conclusion then, is, that neither the representatives of a nation, nor the whole nation itself assembled, can validly engage debts beyond what they can pay in their own time.”

Madison wrote back that he generally agreed but thought debt was justifiable if it built a project that benefited the future taxpayer – a useful bridge, for example. Jefferson answered that the power to borrow was too dangerous to allow exceptions – any exception would expand or destroy the prohibition.

Madison’s argument seemed plausible, but Jefferson’s camel’s-nose-under-the-tent concern was right. No government will stay within Madison’s exception. World War II, the last time this country could make any kind of legitimate case for a benefit to future generations, was in fact financed 47 percent by pay as you go taxes, which provided $137 billion out of a total cost of $304 billion.

Jefferson could not get his 1798 amendment adopted, but the country got more chances to adopt Jeffersonian principles in 1994, 1995, and 1996 when Sen. Sam Nunn (D., GA) proposed a Balanced Budget Amendment. At the time, the national debt was large (about four trillion dollars) but could have been dealt with. It was not yet a perpetual debt.

Senator Nunn called his legislation the “Jefferson Amendment.” It required that Congress balance expenses with revenues [and] the public constantly supported Nunn’s amendment by 75-percent margins. But he was defeated by the Clinton Cabinet, which argued that the economy would crash if the federal government couldn’t borrow.

A New York senator said the amendment’s passage could “lead to the devastation of the banking industry.” With the defeat of the Nunn Amendment, the boat sailed for the Republic.”
