A Constitution Inadequate to the Conduct of the War

As General Samuel G. French suggests below, presidential expedients not found in the United States Constitution were invented for initiating war against the South, and for the prosecution of that war. French believed that the New England-armed men in Kansas were responsible for firing the first shot of the war; others have postulated that the war began when the Star of the West left its New York moorings in early January 1861, carrying armed men below decks to South Carolina – when Fort Sumter’s guns were turned against the Americans it was built to protect.

A Constitution Inadequate to the Conduct of the War

“Sherman — the fell destroyer — had burned the city of Jackson, Mississippi, and the ruins reminded me of Pompeii. In walking one of the streets I passed a canvas shanty, from which I was hailed by an Israelite with “Good morning General; come in.” He had been in the army and knew me; he had some goods and groceries for sale. When I was leaving, he asked: “General, cant I do something for you? Here are fifty dollars, just take them; maybe you can pay me back sometime.”

I thought the angel of mercy was smiling down on us . . . I thanked him kindly, and the day came when I had the pleasure of repaying the debt. The servants I had in Columbus had been nominally “confiscated” and set free; so they came to me, almost daily, begging me to take them back to the plantation in Mississippi. As I was not able to do this, I applied to some “bureau,” that had charge of the “refugees,” for transportation of these Negroes, and to my surprise it was granted. As soon as possible they were put on the cars and started for the plantation.

When we reached home we found most of the old servants there awaiting our arrival. To feed and clothe about a hundred of these people, and to plant a crop of cotton in the spring, clothing, provisions, mules, wagons, implements, harness, etc., had to be procured. To obtain funds to purchase the articles enumerated — to commence again — I went to Philadelphia and New York (by special permission of the government) in November.

. . . War is the most uncertain of all undertakings of a nation, and, like the tempest, cannot be controlled, and seldom or never ends as predicted. The North proclaimed that this “little rebellion” would end in sixty days!

It lasted four years, and ended as no one had foreseen. It had to suppress rebellions caused by people who entertained Southern opinions in New York, Chicago, Cincinnati and other cities; muzzle the press, prohibit free speech, banish prominent individuals, arrest men without warrant, and imprison them without charges made known to them; and violated nearly every resolution and pledge made in the beginning relating to the South; they cast aside constitutional law, and substituted martial law, under which the South became a scene of desolation and starvation.

My own opinion is that the first gun was fired, at the instigation of a number of prominent men North, by John Brown at Harper’s Ferry, and for which he was apotheosized and numbered among the saints.

Mr. Lincoln said: “The dogmas of the quiet past are inadequate to the stormy present. The occasion is piled high with difficulty, and we must rise with the occasion. Our case is new. We must think anew, and act anew. We must disenthrall ourselves, and then we shall save the country.”

These words indicate that the powers of the Constitution were inadequate to the conduct of the war, and henceforth the war must be conducted as occasion deemed expedient. In other words, the executive must be declared greater than the power that made it, or the creature greater than the Creator, and with dictatorial methods the war was conducted. Avaunt, Constitution, avaunt! We are fighting for the Union, for dominion over the Southern territory again, and so the Constitution was folded up, etc.”

Republicans and the Freedmen’s Role

The North’s Republican Party was solely responsible for the postwar Solid South which opposed their Reconstruction efforts, and the former utilized the newly-enfranchised freedmen to establish a Southern wing to maintain their national hegemony. To hold Northern votes the Republicans waved “the bloody shirt”; at the same time they swayed the black voter with warnings of newly-elected Democrats re-enslaving them.  Below, the home State of Carl Schurz was not Missouri, he was a socialist revolutionary from Erftstadt, Germany, and elevated by Lincoln to attract German immigrant support for his war.

Republicans and the Freedmen’s Role

“One of the first [Northerners] to change his mind about the freedmen was Carl Schurz. In 1865, after a Southern tour, he had recommended that the Negro be enfranchised, disregarding the fact that “the [white] masses are strongly opposed to colored suffrage.” But in 1870, when he realized that uneducated Negroes were an easy prey for spoilsmen, Schurz admitted that he had erred.

To his disgust the [Republican] machine politicians in Missouri, his home State, dominated the scene by manipulating ignorant, but enfranchised, Negroes. Henceforth, Schurz steadfastly opposed all legislation designed to aid the colored man. And he assumed that anyone who tried to stir up sectional passions had yielded to the worst elements in the Republican organization.

Although the transition in the thinking of George William Curtis, the editor of Harper’s Weekly, was far different, he eventually reached the same conclusion. Like Schurz, Curtis after the war favored Negro suffrage. He argued that the freedmen had proven their loyalty and deserved the ballot. Admittedly, many of them were ignorant, but so were “great masses of Northern voters. Education,” he wrote, “is a good thing; but it appears some of the staunchest patriots in the land cannot read, and that some of the basest traitors are highly educated.”

During the 1880 campaign Harper’s Weekly vigorously denounced the Solid South. He then said that the Southern question was dead. The federal government could do nothing more to help the Negro. After that, Curtis joined Schurz in resisting all attempts to stir up the race issue.

A third distinct case was Edwin L. Godkin of the Nation. Although he begrudgingly advocated the enfranchisement of the Negro after the Civil War, he never abandoned the conviction that white Anglo-Saxons were inherently superior to “ignorant foreigners” and atavistic colored men. “I do not oppose the admission [to suffrage] of such Negroes as shall prove their fitness,” Godkin wrote in 1865. “. . . What I ask, and meant to ask, was not that the blacks shall be excluded as blacks, but simply that they shall not be admitted to the franchise simply because they are blacks and have been badly treated.”

Godkin recommended the disenfranchisement of all Negroes who could not learn to read or write within two years. Only by developing his intelligence could the colored man distinguish between “statesman and demagogue; between honest public men and knavish public men; between his own real friends and his real enemies.”

Although Godkin originally supported the Radical plan of Reconstruction, which provided for military enforcement of Negro suffrage, he was convinced by 1871 that this adventure had failed.

“We owe it to human nature to say that worse governments have seldom been seen in a civilized country,” the editor admitted. “They have been composed of trashy whites and ignorant blacks.” Control of Southern affairs should be returned to those “who have most influence and knowledge.” The simple truth was that the freedmen were unfit for the role the Republicans desired them to play: “Any party in which the Negro is in the majority, cannot help having its policy, if not shaped, greatly influenced by their political ignorance and incapacity.”

Pillaging and Flattening American towns

Referring to his prewar employment and residence in Louisiana, the Macon [Georgia] Telegraph called the destructive Sherman “Judas Iscariot, a betrayer, a creature of depravity, a demon of a thousand fiends.” As for Sherman’s misunderstanding of treason, it is clearly defined in Article III, Section 3 of the United States Constitution as “levying War against them [the united States], or in adhering to their Enemies, giving them Aid and Comfort.” Sherman, by order of his commander, Lincoln, waged war against the united States.

Pillaging and Flattening American Towns

“Officially, Sherman’s orders to his officers were against capricious violence and destruction on his army’s sweep through South Carolina. But the true desires of their leader filtered back to Sherman’s men as they slogged through the swamps under the dripping moss of the live oaks in South Carolina Low Country. Sherman issued few, if any, restraining orders to the troops.

South Carolina is where treason began, and there, Sherman swore, was where it would end. And so, to Sherman’s implied commands, the troops responded with a greater vengeance than they had in Georgia.

Villages in Sherman’s path through the Low Country were virtually obliterated: Hardeeville, Purysburg, Robertville, Lawtonville, Allendale. At least one brigade – often two or more a day – marched through, pillaging and flattening the towns and the lands between mid-January and early February 1865.

The forces commanded by Lieutenant-Colonel Edward S. Solomon of the 82nd Illinois Infantry of Operations seem to have been particularly effective in razing the hometowns of the Willingham and Lawton families.

In a postscript to a report that Colonel H. Case of the 129th Illinois Volunteer Infantry, First Brigade, Third Division, Twentieth Corps, had made . . . reported that a forage party near Camden “has captured at last a portion of the assets of the Bank of South Carolina and the Bank of Camden and also a quantity of jewelry and silver plate” and that “the safes were delivered to the Provost Marshal of the Twentieth Corps.”

Shortly after Lee’s surrender, a correspondent of the New York Times wrote, “I hazard nothing in saying that three-fifths [in value] of the personal property we passed through were taken by Sherman’s Army.”

Questions Solved Only by War

Sherman was unable to understand that the South was fighting a defensive war to maintain its independence, and had no desire to alter the governance of the Northern States. Sherman wrote the following in late 1863 to his superior, noting that he saw no need for civil compromises to soften the war against the women and children in his path, and that “the South has done her worst [in its struggle for independence], and now is the time for us to pile on blows thick and fast.” Sherman could not see the humanity suffering in his midst, only faceless enemies obstructing his employer’s will.

Questions Only Solved by War

“For such a people, [Sherman wrote], “a civil government now . . . would be simply ridiculous.” The interests of the United States “demand the continuance of the simple military rule after all the organized armies of the South are dispersed, conquered and subjugated.” The only real issue, he wrote, was, “Can we whip the South?”

[Sherman continued] “Another great and important natural truth is still in contest, and can only be solved by war. Numerical majorities by vote have always been our great arbiter. The South, though numerically inferior, contend they can whip the Northern superiority of numbers, and therefore by natural law contend that they are not bound to submit.

This issue is the only real one . . . War alone can decide it.

I would banish all minor questions, assert the broad doctrine that a nation has the right, and also the physical power to penetrate every part of our national domain, and that we will do it – that we will do in our own time and in our own way . . . that we will remove and destroy every obstacle, if need be, take every life, every acre of land . . . that we will not cease till this end is attained . . . I would not coax them or even meet them halfway but make them so sick of war that generations would pass away before they would again appeal to it . . .”

Preaching Racial Hatred in the South

Descending upon the prostrate South were the “Carpetbaggers” – Northern adventurers settling in the South and bent upon aiding the Republican Party through organizing the freedmen politically. Many were “astute demagogues who through vague speeches and tricks of mass organization won the confidence of the naïve Negro.” Northern newspaperman Horace Greeley described them as “stealing and plundering, many of them with both arms around Negroes, and their hands in their rear pockets, seeing if they cannot pick a paltry dollar out of them.” The infamous Union League was the destructive instrument of the Republican Party which drove a political wedge between Southern blacks and whites.

Preaching Racial Hatred in the South

“Scalawags were Southerners willing to espouse Republicanism for reasons of opportunism. When the pro-Negro policies of the carpetbaggers caused the scalawags to desert Republicanism, Northern leaders, conscious of the power of numbers, to an ever greater degree relied upon pure Negro support.

The principal agency of the carpetbaggers was the Union or Loyal League. Initially it was composed almost entirely of white unionists with patriotic rather than political aims. As the [radical] plans of Congress unfolded in 1867, its main purpose became the organization of Negro voters [as Republicans]. In every Southern community trusting Negroes were organized into secret lodges of the order which indulged in mummery and high-sounding platitudes. In its heyday the Union League was said to have more than 200,000 members.

Ceremony, talk about freedom and equal rights, sententious references to the Declaration of Independence, accompanied by the clanging of chains, the burning of weird lights, and prayers and songs – all had their compelling effect upon the Negroes’ emotions and thoughts. They were repeatedly reminded that their interests were eternally at war with those of Southern whites, and that their freedom demanded the continued supremacy of the Republican party.

As a consequence of these teachings, the Union League “voted the Negroes like “herds of senseless cattle.” One member described it as the ‘place we learn the law.” When asked why he voted Republican, another member replied “I can’t read, and I can’t write . . . We go by instructions. We don’t’ know nothing much.”

During the presidential campaign of 1868, the Union League of North Carolina declared that if Grant were not elected, the Negroes would be remanded to slavery; if elected, they would have farms, mules, and hold public office.

One fact is of fundamental importance in understanding the course of radical Reconstruction: the Negroes were aroused to political consciousness not of their own accord but by outside forces. This revolution in Southern behavior, unlike the more lasting political revolutions of history, was not a reflection of accomplishments in other fields.

Attainment of political equality by the Negroes, in other words, was not attended by social and economic gains, possibly not even signifying a general demand for these advantages.

Such a lack of support not only meant that the radical political experiment could be destroyed almost as easily as it was created, but that participation of the Negro in politics would be erratic and irresponsible. Even if it had not been that way, it would have been so regarded, because the Negroes did not preface their attempt to win political equality with the attainment of respect in other fields of social endeavor.”

The Un-Progressive South

By 1850, the American South had had enough of Northern agitation regarding the slavery in their midst and saw abolitionists as unreasoned, ideological fanatics who could produce no practical or peaceful means to do away with that residue of British colonialism. The Un-Progressive South

“The union of classical and Christian culture gave Southerners an immunity – even before the War – to the modern virus of progressive ideology which had seized the North by the 1830s.

Criticism of Northern society by the likes of Robert Dabney, William Gilmore Simms and Edgar Allen Poe brought into stark relief the difference between the classical Aristotelian understanding of rational criticism favored by the South and the hubristic ideological critiques of Henry Thoreau, Ralph Waldo Emerson and Walt Whitman.

Lincoln made the ideological style of politics popular with the Gettysburg Address, where he defines America not as a historic federation of States, each cultivating, in its own terms, political and legal institutions inherited from Europe (and especially from Britain), but as a polity with a mission to shape society in accord with an abstract “idea” of equality.

By the 1950s, the ideological style of politics had become so popular that Richard Hofstadter could say approvingly, “it has been our fate not to have an ideology, but to be one.” Rather than see as a pathological condition of the intellect, it is celebrated as a great achievement and as an instance of American “Exceptionalism.”

As Al Gore and countless other pundits have put it, America is a country that constantly “reinvents itself.” Arthur Schlesinger defined American identity in this way: “The American character is bottomed upon the profound conviction that nothing in the world is beyond its power to accomplish.” And the “conservative” Ronald Reagan was fond of repeating Thomas Paine’s remark that we have it in our power to begin the world anew.

Southerners know we have no such power, and should resist the temptation to use it if we had it. The Yankee critic responds that Southerners have an intolerably relaxed tolerance of evil. But Southerners do not have a high tolerance for evil. Rather, they recognize the reality of original sin. They know how hard it is to eradicate sin from their own conduct much less reconstruct society as a whole with all the unintended consequences that generates.

Balanced “reform” is one thing, but belief in “progress” whether of the liberal or Marxist kind, is not only the pursuit of an ever-receding goal of “equality,” it is also a self-imposed innocence that protects the progressive from having to recognize his failures and the destruction caused by beginning the world anew or event totally rebuilding a part of it. Anti-slavery agitation in the antebellum North was almost entirely ideological and sentimental.

Nowhere in this agitation do we find an acknowledgement that the slaves were brought over by the North and that Northern wealth as of 1860 was founded on the slave trade and on servicing slave economies for over two centuries.

Morality demanded a national program to emancipate slaves, compensate slave holders and integrate slaves into American (including Northern) society. Northern anti-slavery agitators were not within a million miles of supporting such a proposal. What they demanded was immediate and uncompensated emancipation.”

GOLDSBOROUGH, N. C., March 24, 1863.

Maj. Gen. J.G. FOSTER, Federal Army.

SIR: Two communications have been referred to me as the successor of Gen. French. The prisoners from Swindell’s company and the Seventh North Carolina are true prisoners of war and if not paroled I will retaliate five-fold.

In regard to your first communication touching the burning of Plymouth you seem to have forgotten two things. You forget, sir, that you are a Yankee and that Plymouth is a Southern town.

It is no business of yours if we choose to burn one of our own towns. A meddling Yankee troubles himself about every body’s matters except his own and repents of everybody’s sins except his own. We are a different people. Should the Yankees burn a Union village in Connecticut or a cod-fish town in Massachusetts we would not meddle with them but rather bid them God-speed in their work of purifying the atmosphere.

Your second act of forgetfulness consists in your not remembering that you are the most atrocious house-burner as yet unsung in the wide universe.

Let me remind you of the fact that you have made two raids when you were weary of debauching in your Negro harem and when you knew that your forces outnumbered the Confederates five to one. Your whole line of march has been marked by burning churches, school-houses, private residences, barns, stables, gin-houses, Negro cabins, fences in the row, &c.

Your men have plundered the country of all that it contained and wantonly destroyed what they could not carry off.

Before you started on your freebooting expedition toward Tarborough you addressed your soldiers in the town of Washington and told them that you were going to take them to a rich country full of plunder. With such a hint to your thieves it is not wonderful that your raid was characterized by rapine, pillage, arson and murder.

Learning last December that there was but a single weak brigade on this line you tore yourself from the arms of sable beauty and moved out with 15,000 men on a grand marauding foray. You partially burned Kinston and entirely destroyed the village of White Hall.

The elegant mansion of the planter and the hut of the poor farmer and fisherman were alike consumed by your brigands. How matchless is the impudence which in view of this wholesale arson can complain of the burning of Plymouth in the heat of action!

But there is another species of effrontery which New England itself cannot excel. When you return to your harem from one of these Union-restoring excursions you write to your Government the deliberate lie that you have discovered a large and increasing Union sentiment in this State.

No one knows better than yourself that there is not a respectable man in North Carolina in any condition of life who is not utterly and irrevocably opposed to union with your hated and hateful people.  A few wealthy men have meanly and falsely professed Union sentiments to save their property and a few ignorant fishermen have joined your ranks but to betray you when the opportunity offers. No one knows better than yourself that our people are true as steel and that our poorer classes have excelled the wealthy in their devotion to our cause.

You knowingly and willfully lie when you speak of a Union sentiment in this brave, noble and patriotic State. Wherever the trained and disciplined soldiers of North Carolina have met the Federal forces you have been scattered as leaves before the hurricane.

In conclusion let me inform you that I will receive no more white flags from you except the one which covers your surrender of the scene of your lust, your debauchery and your crimes. No one dislikes New England more cordially than I do, but there are thousands of honorable men even there who abhor your career fully as much as I do.

The Dimensions of Southern Identity

The fundamental reason for the 1860-1861 withdrawal of Southern States from the 1787 Union was to achieve political independence, and distance themselves from the changed and radicalizing Northern States which had become increasingly populated by immigrants fully unfamiliar with the United States Constitution. That North was seen as a threat to the safety and liberty of the Southern people and therefore a separation was inevitable. The Dimensions of Southern Identity

“Southern identity is not a mere regional identity such as being a Midwesterner or a New Englander. The South was an independent country, and fought one of the bloodiest wars of the nineteenth century to maintain its independence. No group of Americans in any war have fought so hard and suffered so much for a cause.

That historic memory as well, as resistance to the unfounded charge of “treason,” is built into the Southern identity. The South seceded to continue enjoying the founding decentralized America that had dominated from 1776 to 1861. We may call it “Jeffersonian America” because it sprang from both the Declaration of Independence and Jefferson’s election which was called “the Revolution of 1800.”

This founding “Jeffersonian America” was largely created and sustained by Southern leadership. In the first 67 years only 16 saw the election of Northern presidents. In the first 72 years, five Southern presidents served two terms. No Northern president served two terms.

The Republican Party was a revolutionary “sectional party” determined to purge America of Southern leadership and transform America into a centralized regime under Northern control.

When Southerners seceded, they took the founding “Jeffersonian America” with them. The Confederate Constitution is merely the original U.S. instrument except for a few changes to block crony capitalism and prevent runaway centralization.

Part of Southern identity is its persistent loyalty to the image of decentralized Jeffersonian America. To be sure, libertarians and others outside the South have a theoretical commitment to decentralization, but none have the historical experience of suffering to preserve the founding Jeffersonian America.

But the deepest dimension of Southern identity is found in Flannery O’Conner’s statement that Southern identity in its full extent is a “mystery known only to God,” and is best approached through poetry and fiction. The humiliation of defeat and the rape of the region by its conquerors have given Southerners a clarity about the limits of political action, the reality of sin, and the need of God’s grace.”

Mobilizing the Hate of the People

The Lincoln administration utilized both censorship and propaganda in its effort to conceal the immense carnage and early defeats from the Northern public, as well as portray the South as murderers of noble Union soldiers who were defending the Founders’ republic. After Lincoln’s reelection in 1864, the campaign of hatred toward the South intensified to ensure that the South would remain a subject colony and economic wasteland — plus a source of freedmen votes to ensure Republican political hegemony.

It is true that Northern men hated the draft and did not flock to the colors; generous bounties were required to attract recruits and most often these were foreigners. Many posed the question the North was reluctant to ask: “If the cause of the Union was such a noble one, why was there so much violent opposition to the idea of fighting for it.” It was British propaganda that helped bring America into the First World War, despite a president being elected on a pledge of no American boys dying on European battlefields.

Mobilizing the Hate of the People

“There was no richer field for propaganda than the United States of America in the first years of the war. Atrocities, Germany’s sole responsibility, the criminal Kaiser, and all the other fabrications started in Great Britain, were worked up by American liars with great effect.

The Belgian baby with no hands was a special favorite. There was hardly a household in which it was not discussed all over that vast continent, and even so ridiculous a scare as the concrete platforms for German guns was current in California. Villages were burned [by the Germans], women carried off, and various cruelties perpetrated.

After America entered into the war a number of “actual war picture” films (prepared at Hollywood) were released. An immense army of speakers and pamphleteers were employed by the Committee on Public Information, and the country was flooded with literature describing the iniquities of the Hun.

An interesting volume on the technique of propaganda was recently published by [political scientist and communications theorist] Professor [Howard D.] Lasswell, of Chicago, from which the following passage may be quoted:

“So great are the psychological resistances to war in modern nations that every war must appear to be a war of defense against a menacing, murderous aggressor. There must be no ambiguity about whom the public is to hate. The war must . . . be due . . . to the rapacity of the enemy. Guilt and guilelessness must be assessed geographically, and all the guilt must be on the other side of the frontier. If the propagandist is to mobilize the hate of the people, he must see to it that everything is circulated which establishes the sole responsibility of the enemy.”

Seward’s Hot Potato

Samuel Cutler Ward (1814-1884), known as the “King of the Lobby” due to his exemplary success at high-level political persuasion, was the brother of abolitionist Julia Ward, and served as an intermediary between William Seward and Confederate leaders before the war. Ward told Seward in 1862 that the Confederate leaders would not rejoin the Union as he saw in the South “a malignant hatred of the North which rendered” the destruction of the South necessary. Ward understood that “within two years they would have formed entangling free trade and free navigation treaties with Europe and a military power hostile to us.” Seward may have believed that peace might prevail, but Lincoln and his party’s extremists led the way to war.

Seward’s Hot Potato

“Seward, who was to be Secretary of State, it had become definite, was in a quandary. As he saw the situation, he faced two necessities: one was to guide the inexperienced Lincoln in shaping the policies of the Administration; and the other was to convince his former associates in the Senate, who now headed the insurrectionary Confederacy in Montgomery, that Washington would initiate no hostilities against them, but would follow a policy of conciliation and friendship.

Seward wanted Jefferson Davis, Judah P. Benjamin, and the others to understand clearly that he would be the chief architect of Administration policy; and further, that they could rely on his assurance that this policy would be one of peace, not provocation. In this, of course, he spoke only for himself, but he was convinced that he would be able to shape Lincoln’s view of the situation; Lincoln, he reasoned, was unversed in statecraft, and would be grateful for expert leading by a thoroughly practiced Secretary of State.

Seward’s sincere conviction was that the problem of secession, like all other human disagreements, could be resolved by reasonable discussion among reasonable men. One wing of the Republican party was howling for the forcible suppression of “treason” in the South; this wing was led by Salmon P. Chase of Ohio, and to them Seward’s conciliatory views were themselves barely removed from Treason, — if removed at all. For him to communicate directly with the men in Montgomery might be construed as “communicating with the enemy.”

If he were to communicate with them at all, he would have to work through an intermediary whom both he and Southern leaders could trust . . . [poet, politician and gourmet] Sam Ward.

When Lincoln slunk into Washington in a distressing pusillanimous manner (or so it seemed), supposedly to foil an assassination plot, Sam was disgusted.

Seward was juggling a hot potato tossed to him by three commissioners whom the Confederacy had sent to Washington to treat for the peaceable surrender of United States forts in Southern territory, principally Fort Sumter at Charleston, and Fort Pickens near Pensacola, Florida. The commissioners . . . were well-known to Sam . . . If [they] go back unacknowledged as [commissioners], President Davis cannot hold back the people from attacking the forts.

[Seward] kept stalling the Southern commissioners with excuses – pressure of patronage demands, the delays attendant [to] departmental routine, and such pretexts. He could not receive the commissioners without recognizing the government behind them; yet he did not wish to send them back to Montgomery in anger.”
