Where, Then, Did Jim Crow Come From?

What is known as “Jim Crow” began in the antebellum North and spread southward after Reconstruction. In a region already hostile to black participation in social and political life, New York in the 1820’s proscribed free black votes by raising property requirements and essentially disenfranchising them. They fared no better in Philadelphia which Frederick Douglas referred to as the most racist city in the US.

Where, Then, Did Jim Crow Came From?

“Before the War, Savannah had Negro units in the local militia and Negro volunteer fire departments. Negro ministers preached from the pulpits of city, as well as rural, churches. Frederick Law Olmstead’s concise “Journey in the Seaboard Slave States” reported Negro passengers in the coaches of railroad train across Virginia and “Negro passengers admitted without demur.”

An Englishwoman, the Hon. Miss Murray, touring prewar Alabama, wrote: “From what we hear in England, I imagined Negroes were kept at a distance. That is the case in the Northern States, but in the South they are at your elbow everywhere and always seek conversation.”

Where, then, did “Jim Crow” come from?

Describing a train ride from Boston to Lowell, Massachusetts in 1842, Charles Dickens wrote: “There are no first and second class carriages with us; but there is a gentleman’s car and a ladies’ car; the main distinction between which is that, in the first, everybody smokes; and in the second, nobody does. As a black man never travels with a white one, there is also a Negro car, which is a great blundering clumsy chest such as Gulliver put to sea in from the Kingdom of Brobdignag.”

That was thirteen years after Garrison founded the “Liberator,” a few blocks from Boston’s North Station, and eight years before Mrs. Stowe would ride in the same Jim Crow’d trains to Brunswick, Maine, to start work on Uncle Tom’s Cabin.

Eli Whitney had died in 1825. But the assembly line firearms he perfected “back home” in New Haven would eventually become standard equipment for Federal armies during the War.

Now, in the sordid years of Reconstruction, “Jim Crow” finally migrated from Boston, too, down past [Eli] Whitney’s grave . . . Slave ships – gin — “Uncle Tom” — Whitney & Ames rifles — Jim Crow. The Yankee cycle was complete.”

An Opportunistic Amalgamation of Factions

The American republic was only 45 years-old when the political seams began bursting and the Founders fears of unbridled democracy had firmly gained root. The Whig’s combined somewhat opposing factions which would not last long in alliance, especially Southerners who strictly interpreted the Constitution and allied to the various isms, higher-law abstractions, and centralizing instincts of New England. From this latter poisonous cauldron Lincoln’s ill-named Republican party emerged.

An Opportunistic Amalgamation of Factions

“To call the Whig coalition a political party is to do it a service above and beyond the call of historical accuracy. It was not a party – not in the European sense, certainly, and probably not in the modern American sense. It was, instead, a loose confederacy of warring factions bound vaguely together by a common hatred of the new popular democracy in general and of General Andrew Jackson and Martin Van Buren in particular.

The party grew out of that hatred in 1833-1835 and it collapsed in confusion of its own internal intellectual and factional contradictions in 1853-1854. During its twenty-year history it elevated two bewildered generals to the White House, William Henry Harrison in 1840 and Zachary Taylor in 1848, and it nominated another – General Winfield Scott – in 1852. These leaders were chosen to head the Whig coalition primarily because they stood for nothing controversial, antagonized no one, and because they could be sold to the voters, as Andrew Jackson had been marketed in 1828, wrapped in an aura of military glory.

When in 1844 the Whigs did nominate a man who stood for something, Henry Clay, the Democrats beat him with James Polk, a political unknown. Party platforms and statements were scrupulously avoided by the Whigs for fear the brawling factions would disintegrate the party in a gigantic internal explosion.

The Whig party was an opportunistic amalgamation of two major factions. Foremost in its councils were the National Republicans, descendants of Hamiltonian Federalism. Led by Henry Clay, Daniel Webster, and John Quincy Adams, they supported the nationalistic American System – tariff protection, internal improvements, national bank – and they were generally loose constructionists of the Constitution. They had no use for slavery . . . [and were] the best organized, best-led, and most influential faction. They most consistently represented the interests of the merchants, shippers, and the new industrialists of the North and Northeast.

Second in power and prestige within the Whig coalition, were the State’s rights Whigs of the South. Former Jeffersonian Democrats, they were variously disenchanted with Andrew Jackson for his spoils system, his Force Bill, and his removal of the Bank deposits . . . They remained . . . strict constructionists, free-traders, and anti-nationalists, and they looked to the continued domination of the national political process by gentlemen. Their hatred of the egalitarian Jackson and all his works was summed up in Mrs. John Floyd’s heated characterization of the General as a “bloody, bawdy, treacherous, lecherous villain.”

Finally, there were the Anti-Masons, that strange and emotional sect that came bursting out of western New York and onto the American political scene in 1831 with little more for a program than the naïve and half-crazed belief that Freemasonry and Americanism were somehow incompatible. Skilled and practical politicians like Thurlow Weed, William H. Seward, and Francis P. Granger quickly moved in on this lunatic fringe and made of it an anti-Jackson, anti-Van Buren faction on the Empire State, dedicated in its principles to the protective tariff and to internal improvements.”

Quoting John Rolfe’s account of the event, John Smith noted that “About the last of August came in a Dutch manne of warre that sold us twenty Negars.” Thus began the importation of Africans to America though their early status of servants or slaves may still be questioned.

White and Black Servants in Early America

“Thanks to John Smith we know that Negroes first came to the British continental colonies in 1619. What we do not know is exactly when Negroes were first enslaved there. This question has been debated by historians for the past seventy years, the critical point being whether Negroes were enslaved almost from their first importation or whether they were at first simply servants and only later reduced to the status of slaves.

During the nineteenth century historians assumed almost universally that the first Negroes came to Virginia as slaves. So close was their acquaintance with the problem of racial slavery that it did not occur to them that Negroes could ever have been anything but slaves.

Philip A. Bruce, the first man to probe with some thoroughness into the early years of American slavery, adopted this view in 1896, although he emphasized that the original difference in treatment between white servants and Negroes was merely that Negroes served for life.

James C. Ballagh . . . took the position that the first Negroes served merely as servants and that enslavement did not begin until around 1660, when statutes bearing on slavery were passed for the first time. Writing on the free Negro in Virginia for the Johns Hopkins series, John H. Russell in 1913 tackled the central question and showed that some Negroes were indeed servants but concluded that “between 1640 and 1660 slavery was fast becoming an established fact. In this twenty years the colored population was divided, part being servants and part being slaves, and some who were servants defended themselves with increasing difficulty from the encroachment of slavery.”

Ulrich Philips of Georgia, impressed with the geniality of both slavery and twentieth-century race relations, found no natural prejudice in the white man and expressed his “conviction that Southern racial asperities were mainly superficial, and that the two great elements are fundamentally in accord.”

[Sociologists and social psychologists] . . . “Liberal on the race question almost to a man, [tended] to see slavery as the initial cause of the Negro’s current degradation. The modern Negro was the unhappy victim of long association with base status. Sociologists, though uninterested in tired questions of historical evidence, could not easily assume a natural prejudice in the white man as the cause of slavery. Prejudice must have followed enslavement, not vice versa; else any liberal program of action would be badly compromised.

Ironically there might have been no historical controversy [regarding when racial prejudice began] if every historian dealing with the subject had exercised greater care with facts and greater restraint in interpretation. Too often the debate entered the realm of inference and assumption. For the crucial years after 1619 there is simply not enough evidence to indicate with any certainty whether Negroes were treated like white servants or not. No historian has found anything resembling proof one way or the other. The first Negroes were sold to the English settlers, yet so were other Englishmen.

That some Negroes were held as slaves after about 1640 is no indication, however that American slavery popped into the world fully developed at that time. Many historians . . . have shown slavery to be a gradual development, a process not completed until the eighteenth century. [Some] Negroes served only the term usual for white servants, and others were completely free. One Negro freeman, Anthony Johnson, himself owned a Negro. Obviously the enslavement of some Negroes did not mean the immediate enslavement of all.”

Truman the Prisoner of Socialist Planners

Author John T. Flynn wrote in 1949 of the communist takeover of the Democrat Party, which was fairly complete in 1936 as FDR’s labor friend Sidney Hillman formed the first political action committee, CIO-PAC, to funnel labor unions funds into his political campaign. By the early 1940’s Southern Democrats had enough of party communists and railed at FDR’s running mate in 1940, Henry Wallace, who was very friendly with the Soviets. Thus came the Dixiecrat Party.

Truman the Prisoner of Socialist Planners

“The country recently witnessed a struggle in the United States Senate around a proposal of the president to put federal force behind the guarantee of what is called “civil rights.” Few of those who read of the filibuster conducted by the Southern Democratic senators understood the real purpose behind this bill.

Ostensibly it was to give our Negro citizens equality of rights of various kinds with their white brethren. But the real objective was little discussed and even less perceived by the casual newspaper reader.

Of course the problem of the Negro and his position in the South and, for that matter, in the North, is a perpetual irritant. It is not easy to square the discriminations against the Negro with a number of the most rapturously repeated phrases in accepted national philosophy. There are some aspects of the question that ought to be kept in mind.

First of all, the lurid and sensational stories about lynchings and hatreds and suppressions and oppressions have been outrageously exaggerated. It is a fact that almost all of the publicity about the outrages against Negroes in the South has originated in the propaganda agencies of the communist trouble-makers.

Why is the communist so deeply stirred about the Negro? Is he trying to correct injustices suffered by the Negro in order to improve his lot here and make him love America more? We know that the communist has one supreme interest and that is to excite and stimulate the hatreds of every class in the country.

Sooner or later this country must face the problem of the Negro. It is simple enough in New York. It is not so simple in Mississippi, where the Negroes almost equal the whites in number, or in Georgia, where Negroes outnumber whites in probably half the counties in the State.

White supremacy is a phrase encrusted with unpleasant connotations in the North. But in hundreds of Southern counties where Negroes outnumber whites the people are sure that if the Negroes voted there would be not white supremacy but Negro supremacy. In light of our professed beliefs about the rights of man, however, it is not an easy matter for our people to face up to this problem squarely.

One day an educated Negro population, rather than the poor cornfield worker and the illiterate serving man, will confront the people of the country. Time, education on both sides of the color line, patience, understanding, may lead us to a happier relationship. But one thing is certain. There is no spot for the trouble-maker, the revolutionist, the communist bent on mischief, on division and disturbance.

The problem was thrown into the Senate in 1949 by [Democrat President Harry Truman]. I have, I believe, made it clear that the President is the prisoner of the socialist planners among his supporters, who elected him and who could break him pathetically tomorrow if it suited their purpose. It was in obedience to their imperious demand that this hurry-up solution of the Negro problem in the south has hurled into the Senate.

Now what was their purpose? Was it love for the Negro? Was it a wish to advance his position? Not at all. The purpose was entirely a part of the effort of these socialist planners to solve the great crucial political problem which confronts them. The Negro is merely to be one of the tools in the job.

[The Republican Party after 1865 has sewn up the black vote] But with the advent of the New Deal and the distress among the Northern and Southern Negroes and the great streams of relief money at the disposal of Democratic politicians, the Negro was brought en masse into the Democratic fold. This, however, hardly describes the performance perfectly.

The depression and the rise of the communist and New Deal socialist wing in New York, with Harry Hopkins sitting at the cashier’s window, made it possible for the socialist wing of the Democratic-Red alliance to capture Negro votes. Today [1949] the socialist movements have that vote in their bag. And they believe they can do the same thing with the Negroes in the South if they can get the vote for them.”

Who First Brought African Slaves to America?

Referred to below is Bartholomew de Las Casas (1474-1566), a chaplain assigned to the Spanish armies invading Cuba. He witnessed the horrible massacre of the native Arawaks of Cuba at the hands of his countrymen and he returned to Spain to present his case to end those atrocities.  Those Spanish ships did not fly any flags of the American Confederacy, though New England slavers did fly the flag of the United States.

Who First Brought African Slaves to America?

”Do you know how it came about that African slavery was first introduced into the New World?

We warrant you not one in ten of the Negro-philists of Europe or this country can properly answer this question. We warrant you also that fully half the enemies of the peculiar institution do not know that Negroes have always in all lands been held as slaves, from times so remote that the memory of man runneth not to the contrary; but firmly believe, that the whole blame of the great oppression rests upon the heads of the slaveholders of the present generation.

To all such allow us to say, the introduction of African slavery into America originated in the humane breast of Las Casas. At that period the aborigines of this country, the poor untutored “savages,” were sorely oppressed by the discoverers and conquerors of the land who used the poor creatures like so many beasts of burden, not even sparing their lives on occasions. Having been accustomed, before the coming of the pale faces, to the utmost freedom, devoting their time to idleness and hunting, they soon proved unequal to the misfortunate change, being incapable of performing the tasks imposed upon them by their new masters, and so perished miserably by the thousands.

To remedy so great an evil, Las Casas bethought him of the experiment of removing the Negroes from Africa to the New World that they might take the place of the poor “savages.” The Negroes were already slaves in their own country — slaves to masters whose authority was absolute — and had been such from time immemorial. Not only were they slaves to men; they were doubly the slaves of every species of degradation as well.

Sunk in the most deplorable barbarism, and guilty of all the wickednesses of the cities of the plain, they also waged incessantly cruel wars amongst themselves, tribe against tribe, and village against village. [African] chiefs built their huts of human skulls, drank the blood of their enemies out of human skulls, and yearly offered up whole hecatombs of human sacrifices; and on the death of every headman of a tribe, hundreds of his slaves were butchered over his grave that they might accompany and serve their dead master in the other world.

Surely, thought the humane Las Casas, there can be no harm in removing such wretches from the thralldom of their heathen masters to the milder sway of civilized men.

And at the time, all humane men every where were of the same opinion. Catholics, churchmen, non-conformists of every persuasion, and infidel philosophers also, all regarded the move as both philanthropic and evangelic.

Certainly good men reprobated on the horrors of the Middle Passage then, as earnestly as they do at the present time; but when they reflected on the horrors left behind — the man-eaters and the bloody human sacrifices — the constant wars between the different tribes — their spiritual degradation and mental darkness — they felt constrained to look upon even the horrors of the Middle Passage as an advance from the darker horrors of the accursed country, whence the poor creatures were being removed.

And so our own New England Puritans became the leading traffickers in slaves, and Boston one of the best slave-marts in the country.”

Why Cannot We Act as Our Fathers Did?

Lincoln as a senatorial candidate used his opponent’s popularity to gain valuable platform time, but ended up losing the race anyway. In these famous debates, he exposed not only his own, but also his own party’s uncompromising vision of sectional hatred, and ultimate war between Americans.

Why Cannot We Act as Our Fathers Did?

“Before the debates, in their Senatorial campaign, Douglas had arranged speeches at Chicago and Springfield. His popularity brought great crowds to hear him. Lincoln sat in the back of the crowds both times, waited for Douglas to finish, and then, as the crowd started to leave, Lincoln announced from the platform that in an hour, “so you can eat dinner,” he would answer Judge Douglas’ speech. The crowd roared, “We’ll be here.”

Douglas publicly denounced this tactic. Then Lincoln proposed that the candidates meet jointly, one against the other, several times in the future. Douglas’ advisors urged him to refuse. Why should he provide the big crowds of voters to hear Lincoln? However, it appeared that it would be politically advisable to go ahead and agree to the debates.

Telegraph lines worked all night and nearly all of America read the next morning what the candidates had said and read greatly contradictory reports on who won the last debate. For example, as to one debate, Republican newspapers said, “Honest Abe chewed up the Little Giant and spit him out to the delight of the crowd.” Of the same debate, Democratic newspapers said, “Douglas knocked out Lincoln’s spindly shanks from under him and as he struggled for composure, the crowd roared at the spectacle.

At a subsequent debate, the “House Divided” speech came up again and Douglas said,” Why cannot we act as our fathers did? In Washington’s army there was no sectional strife. These brave soldiers fought under a common policy; they sought a common destiny, and no one was ready to forego a common aim because he did not agree with his fellows on every idea.”

You might say that Douglas won the debates because after the campaign, the Illinois Legislature voted 54 to 46 in favor of Douglas, and he returned to his senatorial seat.”

Why the Museum of the Confederacy Exists

The documents and presentations at the time the Museum of the Confederacy was created in Richmond clearly define why it exists and in whose memory it is dedicated. The clear intent was that “their immortal deeds and the evidences of their achievements will be preserved in the old home of the President of the Confederacy, where they will remain throughout generations and for all time.”

THE BATTLE ABBEY OF THE CONFEDERATE STATES

An Institution to Preserve the Record of the Deeds of Our Soldiers

The dawn of February 22, 1896 was auspicious — assuredly, in the historic city of Richmond. Old Sol rose in all the vaunted splendor of Italy’s skies. All nature was calm and serene. Who will say that it was not the approving smile of the Lord of hosts upon the truly reverential efforts of our most excellent women in the perpetuation of the truth–the treasuring of evidence and of memorials of the righteousness of the grandest struggle for constitutional right which has ever impressed the page of history?

A representative building of the period in Richmond, the most happy probably in the exemplification of intellectual worth, of social grace and substantial comfort, was the residence of the Chief Magistrate of the Confederate States, whilst they blazed into undying glory. This memorable edifice, the patient, devoted women of Richmond undertook to restore enduringly to its original conditions of form, with the sacred purpose of dedicating it to the preservation of the materials of history and hallowed memorials of Southern heroism and sacrifice.

The natal day of Washington was happily chosen for the opening of the building as the Confederate Museum, and to commemorate the formation of an institution for the preservation of the records of glorious deeds of the Southern sons who went forth to battle in defense of honor, truth and home; and the foundation of a permanent repository for the relics of the war between the States.

The former home of Jefferson Davis, the President of the Confederate States, is a most appropriate place for the location of the Confederate Museum. Situated in the very heart of the capital of the Confederacy, the institution is where it will inspire the pride and interest of every Southern man, woman and child, and will be accorded the loving and tender watchfulness of a fond and patriotic people.

When the City Council gave the Jefferson Davis Mansion to the Confederate Memorial Literary Society for a museum, that organization undertook a high and noble work, the consummation of which on yesterday was a brilliant climax to five years of undaunted energy expended in getting the building into proper condition for the change from a public school-house to a place for the reception of Confederate relics and records. The ladies of the Society have done their work well. The old soldiers may pass away, but their immortal deeds and the evidences of their achievements will be preserved in the old home of the President of the Confederacy, where they will remain throughout generations and for all time.

Virginia Governor O’Ferrall: 

“I think I can say boldly that the bloody strife of 1861 to 1865 developed in the men of the South traits of character as ennobling and as exalting as ever adorned men since the day-dawn of creation. I think I can proclaim confidently that for courage and daring chivalry and bravery, the world has never seen the superiors of the Southern soldiers. I think I can proclaim triumphantly that, from the South’s beloved President, and the peerless commander of her armies in the field, down to the private in her ranks, there was a display of patriotism perhaps unequalled (certainly never surpassed) since this passion was implanted in the human breast.”

General [Bradley T.] Johnson’s Address:

“To-day commemorates the thirty-fifth anniversary of the inauguration of the last rebel President and the birthday of the first. It commemorates an epoch in the grandest struggle for liberty and right that has ever been made by man. It celebrates the baptism of a new nation born thirty-five years ago to-day. I believe our first and most sacred duty is to our holy dead, to ourselves, and to our posterity.

It is our highest obligation to satisfy the world of the righteousness of our cause and the sound judgment with which we defended it. And we injure ourselves, we impair the moral of our side by incessant protestations of our loyalty to the victor and continuous assertions of respect for his motives of forgiveness, for his conduct, and of belief in the nobility of his faith.

There never can be two rights, nor two wrongs — one side must be right, and therefore, the other is, of course, wrong. This is so of every question of morals and of conduct, and it must be pre-eminently so of a question which divided millions of people, and which cost a million of lives. The world is surely coming to the conclusion that the cause of the Confederacy was right. Every lover of liberty, constitutional liberty, controlled by law, all over the world begins to understand that the past was not a war waged by the South in defense of slavery, but was a war to protect liberty, won and bequeathed by free ancestors.

Virginia never seceded from the Union. She resisted invasion of rights, as her free ancestors for 800 years had done with arms and force. Before the ordinance of secession was voted on, Virginia was at war with the Northern States, and all legal connection had been broken with them by their own act in the unlawful invasion of her soil. It is this constant and growing consciousness of the nobleness and justice and chivalry of the Confederate cause which constitutes the success and illuminates the triumph we commemorate to-day. Evil dies; good lives; and the time will come when all the world will realize that the failure of the Confederacy was a great misfortune to humanity, and will be the source of unnumbered woes to liberty.

There were more rebel brigadiers killed in battle for the Confederacy than in any war that was ever fought. When such men and women have lived such lives, and died such deaths in such a cause, their memories will outlast time. Martyrs must be glorified, and when the world knows and posterity appreciates that the war was fought for the preservation and perpetuation of free government, of government by the people, for the people, and to resist government by force against the will of the people, then the Confederacy will be revered like the memories of Leonidas at Thermopylae, and Kosciusco and Kossuth, and all the glorious armies of martyrs.

Our memorial will be here in Richmond . . . it is a memorial of no “Lost Cause.” [We] were right, immortally right, and [the] conqueror was wrong, eternally wrong. The great army of the dead are here, the sentiment of the living is here, the memories of the past are here, the monuments of the future will be here. The memorial of the Confederacy is here, not built by hands — made by memory and devotion! What else could it be?”

Will the South Survive?

Southern States seem to be outbidding each other on how many tax dollars can be given away to big business or Hollywood and calling the extortion “economic incentives” —  thinking that somehow it is the duty and obligation of government to create employment for all.  Will the South Survive?

“The Tullahoma local newspaper reported that the town was trying to pass liquor by the drink laws to woo “up-scale” restaurants to locate themselves at the interstate interchanges. Such new South boosterism has made heavy inroads into local culture.

New South boosterism began in the nineteenth century with Henry Grady, editor of the Atlanta Constitution newspaper. Boosters and their legislation promised that all the South needed was to give up everything that makes us the south and become just like the North, and we would all be happy and wealthy (nobody mentions boring).

A Chamber of Commerce might conclude that we need to entice more national chains to establish prosperity, but chains and industry move elsewhere, leaving behind unemployment, a victim mentality, and no lasting prosperity. I call this kind of approach, “homo economicus” anthropology. It reduces everything – and every man – to a question of money.

One hundred and twenty years later, the promised still haven’t been fulfilled. I don’t know whether to laugh or cry, or puke, but I am pretty sure that passing liquor-by-the-drink laws will not bring economic nirvana to Tullahoma. When you make a bargain to sell your soul, first make sure that the devil can pay.

Will boosterism finally gobble up the South? On the surface, the homogenization of culture that come with the local economy relying on big business and chain stores means we are steadily being de-Southernized. The whole effect is to homogenize and standardize the landscape. That seems to be proceeding fast, while the people themselves seem unchanged. What’s happening to the roots of Southern culture is anybody’s guess. On the outside the country here is peaceful, pleasant, friendly, independent and helpful, but at the same time there’s that welfare mentality, some very fat people, and loads of government economic intervention.

The courthouses at the heart of each county tell this story of the South eloquently. Giles County 1910 courthouse retains the integrity of the South’s past. In Lawrenceburg sits a hideous 1960s “Modern” courthouse. In Waynesboro looms a 1970s tenement-style concrete slab. In Winchester squats a blocky 1936 “American fascist” look that would gladden the heart of any fascist or Soviet architect.

Gone are the stately courthouses, the statues of soldiers holding muskets and facing north, symbols of the community’s continuity and long life, and with them fast disappears our local history.

Nevertheless, many of these counties have attracted back-to-the-land, simple-life people, and their roots are permanent so they will recreate permanent prosperity. The land is rich, the people true, the leadership clueless. I could move elsewhere, but Tennessee is my home. Our family could do a lot worse than finding itself at home here.

Perhaps the fate of the Magic Road says it all. The State is turning Highway Sixty-four into a four-lane, bypassing exquisite little villages like McBurg and big towns alike. I know it’s faster, but God help me, I do love the old road better.”

The Responsibility for Suffering Prisoners

Southern men held captive and starving in cold Northern prisons were surrounded by bountiful harvests and plentiful medicines while Northern prisoners shared the meager rations of their guards. Though the South had little medicine and scarce foodstuffs, a lower percentage of Northern prisoners died in the South than the reverse. Below are excerpts from the Joint Select Committee of the Confederate States Congress, investigating the conditions of prisoners after the US Congress issued a report condemning alleged Confederate mistreatment of Northern prisoners.

The Responsibility for Suffering Prisoners

“[We] deem it proper at this time to make a preliminary report, founded on evidence recently taken, relating to the treatment of prisoners of war by both belligerents. This report is rendered especially important, by reason of persistent efforts lately made by the Government of the United States . . . to asperse the honor of the Confederate authorities, and to charge them with deliberate and willful cruelty to prisoners of war.

The candid reader of [Northern publications claiming Southern cruelties] will not fail to discover that, whether the statements they make are true or not, their spirit is not adapted to promote better feelings between the hostile powers. They are not intended for the humane purpose of ameliorating the condition of the unhappy prisoners held in captivity.

They are designed to inflame the evil passions of the North; to keep up the war spirit among their own people; to present the South as acting under the dominion of a spirit of cruelty, inhumanity and interested malice, and thus to vilify her people in the eyes of all on whom these publications can work.

They are justly characterized by the Hon. James M. Mason as belonging to that class of literature called the “sensational” – a style of writing prevalent for many years at the North, and which, beginning with the writers of newspaper narratives and cheap fiction, has gradually extended itself, until it is now the favored mode adopted by medical professors, judges of courts and reverend clergymen, and is even chosen as the proper style for a report by a committee of [the Northern] Congress.

The intent and spirit of this [Northern congressional] report may be gathered from the following extract: “The evidence proves, beyond all manner of doubt, a determination on the part of rebel authorities, deliberately and persistently practiced for a long time past, to subject those of our soldiers who have been so unfortunate to fall into their hands, to a system of treatment which has resulted in reducing many of those who have survived and been permitted to return to us, to a condition both physically and mentally, which no language we can use can adequately describe.”

The evidence proves that the rations furnished to prisoners of war in Richmond and on Belle Isle, have been never less than those furnished to the Confederate soldiers who guarded them, and have at some seasons been larger in quantity and better in quality than those furnished to Confederate troops in the field. How often the gallant men composing the Confederate army have been without meat, for even long intervals, your [US Congressional] committee does not deem it necessary to say.

Once and only once, for a few weeks, the prisoners were without meat, but a larger quantity of bread and vegetable food was in consequence supplied to them.

The scarcity of meat and of bread stuffs in the South in certain places has been the result of the savage policy of our enemies in burning barns, filled with wheat or corn, destroying agricultural implements, and driving off or wantonly butchering hogs or cattle. Yet amid all these privations, we have given to their prisoners the rations above mentioned.

But the question forces itself upon us why have these sufferings been so long continued? Why have not the prisoners of war been exchanged, and thus some of the darkest pages of history spared to the world. In the answer to this question must be found the test of responsibility for all the sufferings, sickness and heart-broken sorrow that have visited more than eighty thousand prisoners within the past two years. On this question, your committee can only say that that the Confederate authorities have always desired a prompt and fair exchange of prisoners.

Soon after [a] cartel was established, the policy of the enemy in seducing Negro slaves from their masters, arming them and putting white officers over them to lead them against us, gave rise to a few cases in which questions of crime under the internal laws of the Confederate States appeared. Whether men who encouraged insurrection and murder could be held entitled to the privileges of prisoners of war under the cartel, was a grave question.

But these cases were few in number, and ought not to have interrupted the general exchange. We were always ready and anxious to carry out the cartel in its true meaning . . . but the fortunes of war threw the larger number into the hands of our enemies. Then they refused further exchanges – and for twenty-two months this policy has continued.

Secretary Stanton, who has unjustly charged the Confederate authorities with inhumanity, is open to the charge of having done all in his power to prevent a fair exchange and thus prolong the sufferings [of Northern prisoners in the South]. [Gen. Benjamin Butler] has declared that in April 1864, the Federal Lieut. General Grant forbade him to deliver to the Rebels a single able-bodied man” . . .

These facts abundantly show that the responsibility of refusing to exchange prisoners of war rests with the Government of the United States, and the people who have sustained that government; and every sigh of captivity, every groan of suffering, every heart broken by hope deferred among these eighty thousand prisoners, will accuse them in the judgement of the just.

Their own savage warfare has wrought all the evil. They have blockaded our ports; have excluded from us food, clothing and medicines; have even declared medicines contraband of war, and have repeatedly destroyed the contents of drug stores and the supplies of private physicians in the country; have ravaged our country, burned our houses, and destroyed the growing crops and farming implements. These desolations have been repeated again and again in different parts of the South. Thousands of our families have been driven from their homes as helpless and destitute refugees.

While thus desolating our country, in violation of the usages of civilized warfare, they have refused to exchange prisoners; have forced us to keep fifty thousand of their men in captivity, and yet have attempted to attribute to us the sufferings and privations caused by their own acts. We cannot doubt that, in the view of civilization, we shall stand acquitted, while they must be condemned.”
