Let the South Depart in Peace

Frederick Grimke’ (1791-1863) wrote about the meaning of American constitutional democracy in his “Nature and Tendency of Free Institutions” of 1848. His work was hailed as a fitting companion to Tocqueville’s Democracy in America as both works at the time were deep philosophical studies of this country’s democratic civilization.

Born in Charleston, South Carolina, Grimke’ was a Southern aristocrat, well-acquainted with American history and possessed a lifetime’s intimate experience with American legal and political institutions.  He parted with what he saw as Tocqueville’s grand mistake “of identifying equality of condition,” instead holding that the American system contained the promise of equality of opportunity.

On the subject of African bondage, he opposed immediate and uncompensated abolition and found himself frequently at odds with sisters Sarah and Angelina, the latter married to the intense Connecticut abolitionist Theodore Weld. Grimke’s first-hand experience with free black communities around Cincinnati convinced him of their not yet being ready to assume the responsibilities of American self-government.

As the sectional gulf between North and South widened, Grimke’ held that States could not nullify federal laws within the Union but were at full liberty to withdraw from that union and form another. He viewed this as akin to a person who had decided to migrate to another country.

He wrote that “no enlightened person who values freedom would contest the right of an individual to emigration; and likewise, none should threaten or compel a State bent on seceding to remain” in a political union it wished to leave.

Grimke’ understood this policy of peaceful departure from the 1789 Union by a group of States to be a lesser evil than war. Grimke’ also believed – as did Jefferson – that a number of regional American confederations might later be created; and while they would have distinct political governments, they would continue to belong, if not to the original union, but to the American democratic civilization which he so greatly prized.”

Policemen in School Corridors?

The US News & World Report, December 6, 1957, pg. 94.

“Juvenile crime in New York public schools no becomes so serious that a grand jury wants to put police inside each school. “Blackboard jungles,” mostly in Negro and Puerto Rican areas, give most difficulty. Crime complaints exceed 2100 this year. Must schools be policed? A top official says, “We do not want Little Rock in New York City.” Yet trouble is mounting.”

NEW YORK CITY – Serious trouble in the public schools of the nation’s largest city broke into the open last week with a recommendation for drastic action.

Delinquency of all kinds had been growing with 1280 arrests made on New York City school grounds thus far this year. These had been for offenses ranging from petty thievery to rape and murder. A special grand jury investigating lawlessness in Brooklyn’s public schools came up on November 25 with this terse recommendation:

“This grand jury recommends that a uniformed New York City policeman be assigned to all schools throughout the city to patrol the corridors, the stairways and the recreation yards as a preventative measure.”

Reaction to the proposal was swift. New York City Superintendent of Schools William Jansen called it “unthinkable.”

Nevertheless, there was agreement that the situation was serious and close to being out of hand. The judge presiding over the grand jury, Samuel Leibowitz stated that “conditions were alarming and that school authorities have been utterly incapable of coping with the situation.”

Most of the “difficult” schools as listed by the city’s Board of Education are situated in predominantly Negro and Puerto Rican neighborhoods. Student achievement levels there are generally below the average for the city and discipline is a major problem. Teachers are reported to be frequently defied by pupils and, in some instances, to be threatened with physical harm by gang members who invade the classrooms.

The at-school crime that finally touched off the grand jury probe occurred in September at Thomas Jefferson High School in Brooklyn. There, a 17-year-old Negro boy hurled a bottle of lye into a classroom, partially blinding one boy and splattering 18 other pupils and the teacher.

Fear of being assigned to a difficult school has hurt teacher recruiting efforts although the extent of the damage cannot be measured. The facts now coming to light about New York’s school problem indicate that troubles here run deep, and serious school problems, it appears, are not confined to the American South.”

Republican Political Virtue in Maryland

The Republican party of Maryland had come to power in 1896 advocating political virtue and responsible leadership. As in other States, this party went right to work in erecting barriers to the Democrat party ever regaining power and diluting their voter strength. In Baltimore, city wards were “renumbered and regrouped in order to assure maximum Republican ascendancy.” Republicans also repealed the Eastern Shore law which denied the traditional assignment of one senator from the east, thus permitting two from the West where Republicans were firmly in control. It took only several years of Republican political virtue for the State’s voters to return the Democrats to power in 1899.

Republican Political Virtue in Maryland

“Even more offensive to the political reform element was the record of political legerdemain of the Republican leaders both in the city and in the State governments. Gov. Lloyd Lowndes personally endeavored to fulfill campaign promises of an honest administration, but his efforts were nullified by chicanery and fraud on the part of his Republican associates. Foremost among these was Congressman Sidney E. Mudd of the Fifth Congressional District who in 1896 while Speaker of the House of Delegates, had extended his influence over the counties of Southern Maryland and, corralling the Negro vote there, had quickly become one of the leading Republican bosses.

Although well-educated, his attitude toward political morality was cynical and can best be exemplified by his own definition of an honest man as “a bastard who will stay bought.”

The worst Republican scandal arose over fraudulent census returns. While serving in Congress in 1900, Mudd had sponsored the appointment of a group of census enumerators for his district and, it was alleged, had intimated to them the type of returns he expected. One of Mudd’s ardent henchmen made certain that census lists for several counties were padded with names secured from tombstones and similar sources. Children aged five and six were listed as day laborers and schoolteachers so that the Federal Census of 1900, insofar as it applied to Southern Maryland, enhanced the influence of Mudd’s bailiwick and gave the Republicans there a sizable number of non-existent voters.”

Republicans, Sectionalism and War

Michigan Senator Lewis Cass was born in New Hampshire in 1782 and quite possibly had seen President George Washington as a young man. A lifelong Democrat and devoted Northwestern man who watched the latter territory develop, he longed to see the sectional troubles developing in the 1850’s resolved with faithful compromise. The nascent Republican party was not to be compromised with, and after electing its first president with a small plurality in 1860, plunged the country into a war it never recovered from.

Passing in 1866, he lived long enough to witness Washington’s republic perish in the flames of sectional warfare.

Republicans, Sectionalism and War

During the deliberations of the Compromise of 1850, Lewis Cass believed slavery to be a misfortune to the South, but only “the passage of ages” could bring about emancipation without the destruction of both races.

On the date July 6, 1854, the Whigs and Free-Soilers, or the “Free Democracy” of Michigan, met and formed a new party. The name Republican was adopted with old party trammels soon cast aside and all bent to the task of forming a party upon the cornerstone of unionism and freedom. This new party was opposed to State sovereignty as well as constitutional interpretations which were contrary to their views, and gave their strength to this party which advocated nationalism.

Though claiming to be a party of Americans for America, its absorption of the fiercely anti-Catholic Know-Nothings meant that only Protestants were to be tolerated.

It was a source of regret to Cass that a party with a “sectional” aim should find support in the country. For above all else he loved the Union, hoping against hope that harmony would be restored. But Michigan, so long faithful to him gave Fremont a popular plurality and elected a Republican legislature with an overwhelming majority.

“You remember, young man,” Lewis Cass said to James A. Garfield in 1861, “that the Constitution did not take effect until nine States had ratified it. My native State [of New Hampshire] was the ninth. So I saw the Constitution born, and I fear I may see it die.”

Though only nine of thirteen States ratified the third Constitution in June, 1788, the others remained fully independent States. And logically, should conventions of any of the thirteen (or subsequent States admitted) revoke or rescind their ratifications to resume their full-independent status and pursue another political arrangement, any lover of freedom and liberty would applaud this.

Civil, Human and Natural Rights

1964 Presidential candidate Goldwater was the last Old Right conservative to emerge after the marginalization of Robert A. Taft by the leftist Rockefeller wing of the Republican party, who cheered on political-waif Eisenhower as their candidate. Ike’s contribution after eight years as president was to appoint Earl Warren Chief Justice as a political payoff, and warning Americans of the military-industrial complex he helped create.

Civil, Human and Natural Rights

“[The authority of individual States] are easy enough to define. The Tenth Amendment does it succinctly: “The powers not delegated to the United States [government] by the Constitution nor prohibited by it to the States are reserved to the States respectively, or to the people.”

Civil rights should be no harder. In fact, however, thanks to extravagant and shameless misuse by people who ought to know better – it is one of the most badly understood concepts in modern political usage.

“Civil rights” is frequently used synonymously with “human rights” – or with “natural rights.” As often as not, it is simply a name for describing an activity that somebody deems politically or socially desirable. A sociologist writes a paper proposing to abolish some inequity, or a politician makes a speech about it – and behold, a new “civil right” is born! The Supreme Court has displayed the same creative powers.

A civil right is a right that is asserted and is therefore protected by some valid law . . . but unless a right is incorporated in the law, it is not a valid civil right and is not enforceable by the instruments of the civil law.

There may be some rights – “natural” or “human”, or otherwise, that should also be civil rights. But if we desire to give such rights the protection of the law, our recourse is to a legislature or to the amendment procedures of the US Constitution. We must not look to politicians, or sociologists – or to the courts – to correct the deficiency.”

War was Lincoln’s Choice

President James Buchanan disagreed with secession as the prerogative of a State, but admitted that he as president held no authority to levy war to stop it — and his attorney general concurred. Both were well-aware of Article III, Section 3 of the Constitution: “Treason against the United States, shall consist only in levying was against them, or in adhering to their Enemies, giving them Aid and Comfort.” Buchanan could not use military force against a State without committing treason.

War was Lincoln’s Choice

“The States of the deep South dissolved their connection with the voluntary union of the United States with marked legality at the beginning of 1861. For a quarter of a year no one knew that there was to be a war. Then Lincoln (unauthorized by the Constitution) called for troops; and the upper South, led by Virginia, seceded.

The point is, Lincoln could have chosen to let the South go in peace on the grounds that a just government depends on the consent of the governed, and the Southern States had withdrawn that consent.

But, said the North, the majority do consent, since there are more people in the North. Even if most of the people in the South do not consent, we in the North are the majority of the whole nation. Thus, the rights of a minority, although a minority of millions, mean nothing.

This is precisely what [Alexis] de Tocqueville warned against: the tyranny of the majority. And Lord Acton was deeply convinced that the principle of States’ rights was the best limitation upon the tyranny of the majority that had ever been devised.

Thus Lee did represent the cause of freedom, and Lord Acton broke his heart over Lee’s surrender because the principle of States’ rights was finally and forever denied.

The America of today is the America that won that immense triumph in the war – the triumph of unlimited, equalitarian democracy. And its leaders have blurred the distinction between freedom and equality to the point where many people use those words as virtually interchangeable terms.”

Cultural Mediocrity and Majority Tyranny Sweeping the Globe

Two young visitors from the Old World who briefly studied America, Alexis de Tocqueville of France and Russian Alexandr Lakier, were historians, jurisprudents, and both involved in public service careers. It is said that Alexis de Tocqueville was fascinated by the idea of political equality in America and wished to obtain first-hand knowledge of this. While Tocqueville, the philosopher, spoke with the upper classes, Lakier was a better reporter on the typical American. Tocqueville arrived in 1831, Lakier in 1857.

Cultural Mediocrity and Majority Tyranny Sweeping the Globe

“Tocqueville came with overpowering credentials. He was able to see everybody who was anybody – presidents, senators, judges, university presidents, scholars, men of letters. He managed, in the brief time he was here, to interview statesmen like Albert Gallatin, John Quincy Adams and Edward Livingston; jurists like Chancellor Kent and Joseph Story; scholars like Edward Everett, Francis Lieber and Jared Sparks; luminaries like Daniel Webster and William Ellerry Channing, and his thinking was profoundly influenced by what these distinguished men told him.

Lakier came on his own, and depended on fortuity for his interviews. He talked with the most miscellaneous people – shipboard acquaintances, workingmen, petty officials, farmers, fur traders, and newly arrived immigrants – a pretty good cross-section of American society.

There was a pervasive melancholy in much that Tocqueville wrote, a conviction that though democracy was indeed the wave of the future, that wave would drown out much that was precious – that democracy would expose every Old World society to the threat of cultural mediocrity, majority tyranny, and the ultimate subversion of liberty.

Lakier, who was by nature more sanguine and more buoyant, looked with confidence to the future – a future that would see the triumph of equality and a closer friendship between the United States and his own nation.

Lakier saw too, that the example of America could not be confined to the Western Hemisphere, but would sweep around the globe . . . “They will have an influence on Europe, but they will use neither arms nor sword nor fire, nor death and destruction. They will spread their influence by the strength of their inventions, their trade, and their industry. And this influence will be more durable than any conquest.”

Truth, Bromides and Sales Talk

“It has hardly been grasped that the media have assumed a strange and dominant role in American politics. They have constituted for more than half a century an impermeable barrier between the voters and the candidates. Nothing has been presented without their prior censorship. Whatever this may be, it is not democracy.

Who are these people who proliferate in print, airwaves, and the internet, and who pass down imperious moral pronouncements without any known credentials to do so? Who voted for them? Who gave them such great and irresponsible power?

Merely by speaking the truth, by refusing to bow to their pretensions, [Donald] Trump has weakened their power. That is all it took. Simply speak the truth, and the “commentators” and “reporters” are revealed as the malicious ignoramuses that they are.

The Republicans have never had the courage to do that. They follow consultants, who warn them not to look unattractively mean-spirited. Don’t speak to the people, and for Heaven’s sake, don’t listen to them. Give them bromides. Anything else will upset the smooth pursuit of office, the only goal that has ever been sought by Republican “leaders” other than protecting and enhancing wealth.

A baker’s dozen of presidential wannabes all spouted identical sales talk. “Conservative” means nothing to them except as a popular advertising slogan.”

A Powerful Force of Militant Democracy

Had England gone to war against the United States in late 1861 over the seizure of two Confederate States diplomats from the RMS Trent, Lincoln’s ports would have been blockaded by the Royal Navy, and Northern shipping destroyed on the high seas in concert with Confederate privateers. Also contemplated was invasion of the undefended American northwest, as well as Canada West — today’s Ontario – thus creating a Northern war front.  Added to this was Maximillian’s French army in Mexico, which may have marched northward to help American’s achieve independence a second time.

A Powerful Force of Militant Democracy

“The prime minister, Viscount Palmerston, was seventy-seven years old in 1861. Born in 1784, just after the American Revolution, he was twenty-eight when Britain went to war again with the United States in 1812. Palmerston had served as foreign secretary in three British governments for a total of about fifteen years.

His involvement with several major US-British disputes had left him with the view that the Americans were pushy, ill-mannered, unyielding in their demands that their rights be respected, and totally lacking in awe of the imperial power of Britain. His continuing fears that the United States would eventually invade and annex Canada ultimately prevented him from supporting a more aggressive British policy toward the American Civil War.

One of Palmerston’s biographers, Jasper Ridley, wrote that “he believed that the British constitution and social system . . . was the best in the world . . . He was a liberal abroad because he wished to see this system replace the absolute monarchies of the Continent.”  But when he looked toward America, Palmerston was no liberal. He was hostile to the idea of a government elected by all of the citizens and, as Ridley noted, was very dubious about militant democracy in America:

“Palmerston had played a very active role in the suppression of the international slave trade . . .  But though Palmerston was delighted when slaves in the intercepted slave ships were liberated by officers and gentlemen of the Royal Navy, he was not pleased at the prospect of the slaves on cotton plantations in the Confederate States being freed by large armies . . . commanded by cigar-chomping generals in ill-fitting uniforms.  And he was as conscious as [John] Bright and the [British] Radicals that the Union armies were the most powerful force of militant democracy since the French revolutionary armies of 1793.”

Oxford professor H.C. Allen wrote that Palmerston “privately . . . hoped for success of the Confederacy because it would weaken a potential rival of Britain’s – and a democratic one . . .”

Catholics and Know-Nothings

Though Massachusetts created the first statutes in America establishing African slavery, Catholics were found to be far worse and unwanted strangers prior to the Civil War. A power-base for the nativist Know-Nothing party of the mid-1800s, the Massachusetts legislature desegregated its public schools in order to exclude Catholics, with one observer commenting that “the legislature might appear to have acted inconsistently, opening Massachusetts schools to one minority group while proposing discriminatory statutes against another. However, blacks were Protestants and native-born, and posed no threat to the Protestant curriculum that Know-Nothings found so important.” By 1856, the Know-Nothing party was absorbed by the new Republican party.

Catholics and Know-Nothings

“As Irish Catholic immigration to New York City and other northeastern cities skyrocketed during the Irish potato famine (1846-1850), and prelates like [Archbishop of New York, John] Hughes began to succeed in obtaining State funds for Catholic schools, nativist political resolve increased. Another factor that increased nativist hostility was the Catholic hierarchy’s refusal to condemn slavery and its [later] apparent support for the Confederacy. In his recent book “Catholicism and American Freedom,” John T. McGreevy . . . argues that the acceptance of slavery among Catholic intellectuals “rested upon the pervasive fear of liberal individualism and social order that so shaped Catholic thought during the nineteenth century, along with the anti-Catholicism of many abolitionists.”

By 1854 the earlier political manifestations of the nativist movement had matured into a full-fledged political party. The American, or Know-Nothing,” party enjoyed short-lived success in the 1854 election, when it won six governorships and achieved majorities in the State legislatures of Massachusetts, New Hampshire, Connecticut, Rhode Island, Pennsylvania, Delaware, Maryland, Kentucky, and California. Despite the low concentration of immigrants in western Pennsylvania, the Know-Nothings did well there . . . attributed to the high percentage of Anglo-Saxon residents in that area combined with “the belief that the Know-Nothings would advance the temperance and anti-slavery movements.”

The main object of Know-Nothing State legislatures was to introduce legislation that would prevent Catholic immigrants from voting. Massachusetts, Connecticut, Rhode Island and Maine passed laws prohibiting State judges from naturalizing immigrants . . . [and] including the first literacy tests for voting, were passed in order to disenfranchise the Irish.

The party’s platform focused on voting rights . . . and requiring the exclusion of foreigners and Catholics from public office. In Massachusetts, where Know-Nothings were strongest, they passed legislation which prohibited the disbursement of public funds to private schools, required that all public school children, including Catholics, read daily from the Protestant King James Version of the Bible, and desegregated the public school system.”
